The basics

This website is owned and operated by Upstate Exotics LLC, 9200 Niagara Falls Blvd, Niagara Falls, NY 14304. By using it you agree to these terms and to our Privacy Policy. If you do not agree, please do not use the site. These terms cover the website only. Purchases made through the online menu are also covered by Dutchie's terms, and purchases in the store are governed by New York law and the store's posted policies.

You must be 21

Cannabis is legal in New York for adults 21 and older. You must be 21 or older to use this website, to join the VIP club, to place an order and to enter the store. We check ID at the door on every visit and at pickup or delivery. Providing false information about your age is a violation of these terms and of New York law.

Information on this site

We work to keep everything on the site accurate, but prices, products, strains, potency, brands, hours and promotions change often and without notice. The online menu is the current source for what is in stock and what it costs. If a price or product on a page differs from the menu or the register, the menu and the register control.

Nothing on this website is medical advice. Product descriptions describe the product. They do not promise any effect. Talk to a doctor about cannabis and your health, especially if you are pregnant, breastfeeding, taking medication or have a medical condition.

Ordering through the online menu

Online ordering and the shop pages are provided by Dutchie, a third-party platform. When you order, you are entering into a transaction with the store under Dutchie's terms of use as well as these terms. Orders are held for pickup for a limited time and are released if not collected. New York purchase limits apply to every order: up to 3 ounces of flower and 24 grams of concentrate per transaction, and edibles are sold in packages of no more than 100 mg THC. We may refuse or cancel any order that would exceed a limit, that cannot be verified, or that appears to be for someone under 21.

Delivery

Delivery is available in the areas listed on our delivery page. The person who placed the order must be present, 21 or older, and show the same ID used to order. Drivers cannot leave products unattended, hand them to anyone else, or deliver to a location other than the address on the order. Any delivery fee shows at checkout before you confirm.

Using the site

You may use the site to learn about the store, browse the menu, order, apply for a job or contact us. You may not use it to scrape or copy content in bulk, interfere with how it works, submit false or abusive form entries, or do anything unlawful. We can restrict access to anyone who does.

Our content

The text, photos, logos and design of this site belong to Upstate Exotics or are used with permission. Brand names and product images belong to their owners. You may share links to our pages freely. Copying our photos or text for another website or business requires our written permission.

Links to other sites

We link to Dutchie, springbig, Google Maps, YouTube, our social profiles and a few news articles. Those sites have their own terms and privacy policies, and we are not responsible for their content.

Disclaimers and limits

The website is provided as is. We do not guarantee it will always be available or error-free. To the extent New York law allows, Upstate Exotics is not liable for indirect or consequential losses arising from your use of the website itself. Nothing in these terms limits any right you have under New York consumer protection law or the rules of the New York State Office of Cannabis Management.

New York law

These terms are governed by the laws of the State of New York. Any dispute about the website will be handled in the courts of Niagara County, New York, unless the law requires otherwise.

Changes

We may update these terms. The date at the top will change when we do, and continuing to use the site after a change means you accept it. Last updated September 7, 2026.
