Who we are
This website, upstateexotics716.com, is run by Upstate Exotics LLC, a licensed adult-use cannabis dispensary at 9200 Niagara Falls Blvd, Niagara Falls, NY 14304, New York license OCM-CAURD-24-000147. When this policy says "we" or "the store," it means Upstate Exotics LLC.

What we collect
We collect as little as we can. Here is everything, by where it comes from.
Things you type into a form
The contact form asks for your name, email, phone number and message. The job application form asks for your name, email, phone, address, work experience, a short note about yourself, and a resume file. We use this information only to answer you or consider your application. Form submissions are emailed to the store and are not stored in a database on this site.
Things your browser tells us
Like most websites, our hosting provider and analytics tools receive your IP address, browser type, device type, the pages you view and the page that sent you here. We use two analytics tools: a privacy-focused, self-hosted analytics service that does not use cookies, and Google Analytics, which does use cookies. Both are used in aggregate to understand which pages people use, and neither is used to build a profile of you.
Things stored on your device
When you confirm you are 21 or older and check "remember me," we store that answer in your browser for 30 days so you are not asked on every visit. That setting lives on your device, not on our servers, and you can clear it in your browser settings at any time.
Things we do not collect here
This website does not take payments and does not store your ID, date of birth, order history or purchase details. The online menu and ordering are provided by Dutchie (see below), and in-store purchases are handled at the register under New York record-keeping rules.
How we use it
- To reply to your messages and applications.
- To keep the website working, secure and fast.
- To see which pages are useful and fix the ones that are not.
- To send you VIP club texts, only if you joined the club (see the SMS Terms & Privacy page).
- To meet our legal obligations as a New York licensed dispensary.
We do not sell your personal information and we do not share it with anyone for their own marketing.
Other companies involved
A few services help run this site. Each one sees only what it needs to do its job and is bound by its own privacy policy.
- Dutchie powers the online menu and order-ahead. When you shop or order, you are using Dutchie and their privacy policy applies to the information you give them, including your ID verification and order details.
- springbig runs the VIP text club. Your name and phone number go to springbig when you join, so they can send the texts and track your points. Details are on our SMS Terms & Privacy page and in springbig's privacy policy.
- Cloudflare hosts and protects the website and processes the traffic data every website host sees.
- Resend delivers our form submissions to the store's email inbox.
- Google provides Google Analytics, the embedded map on our pages, and the YouTube video on our About page. Google's privacy policy covers what Google collects through those tools. The YouTube video uses YouTube's privacy-enhanced mode and loads only when you press play.
How long we keep things
Contact messages and job applications stay in the store's email until they are no longer needed for the conversation or the hiring decision, then they are deleted. Analytics data is kept in aggregate form. Nothing from this website is kept for marketing lists unless you joined the VIP club.
Your choices
- Ask us what we have about you, ask us to correct it, or ask us to delete it. Email [email protected] and we will respond within 30 days.
- Stop VIP texts at any time by replying STOP to any message.
- Opt out of Google Analytics with Google's browser add-on or by blocking cookies.
- Use the store without the website at all. Everything on this site can be done in person at the counter.
New York residents have these rights under state law, and we extend them to everyone who visits.
Age requirement
This website and everything on it is for adults 21 and older. We do not knowingly collect information from anyone under 21. If you believe someone under 21 has sent us information, email us and we will delete it.
Security
The site is served over HTTPS. Form submissions travel encrypted to our email. No method of transmission over the internet is perfectly secure, so please do not send sensitive information such as government ID numbers through the contact form. Bring your ID to the store instead.
Changes to this policy
When this policy changes, the date at the top changes with it. Meaningful changes will also be noted on this page for 30 days. Last updated September 7, 2026.
